Dear customer/Dear service engineer,

by registering in the EKOM App, you give your consent to EKOM, spol. s r. o., Priemyselná 5031/18, 921 01 Piešťany, Corporate ID: 31 416 519, a company registered in the Commercial Register of the District Court of Trnava, section Sro, entry no. 322/T, to collect and process your personal data (first name, surname, and your email address) for the purpose of operating and managing the EKOM App. The objective of the application is to allow the customer to simplify the installation and subsequent maintenance/repair of the product and simplify the registration of service work, all within the scope of the legal obligations of EKOM, spol. s r. o. in the field of health care in accordance with the requirements of the ISO 9001 and ISO 13485 quality management system. As part of improving the quality of its service and increasing the quality of its production, EKOM, spol. s r. o. as the operator of the application reserves the right to store your personal data and all records made through the EKOM App for the duration of the consent to the provision and processing of personal data you granted to EKOM, spol. s r. o., and to subsequently process and analyse your personal data, unless you request the deletion or correction of your personal data.

The EKOM App enables:

• registration and logging in of the user and end user (consumer) of the product of EKOM, spol. s r. o. in the application, access to one's own records and management of one's own database of registered products; 
• registration and logging in of authorised service engineers of EKOM, spol. s r. o. in the application, access to one's own records and management of one's own database of registered products;
• registration of products of EKOM, spol. s r. o.;
• processing and archiving of data related to installation, operation, maintenance and repairs of products registered in the application, access to records pertaining to installation, regular maintenance and repair of registered products; 
• access to User Manuals and Service Manuals of the products registered in the application (access to Service Manuals is only available to authorised service personnel).  

By registering in the EKOM App, you grant EKOM, spol. s r. o. your consent to use your personal data for the following purposes: 

• to create a user profile in the EKOM App;
• to store, view, copy, and create databases and perform analyses in order to meet the requirements of the ISO 9001 and ISO 13485 standards and obligations pertaining to the manufacture, use and maintenance of medical devices stipulated by the law as well as by the Regulation (EU) 2017/745 and the Council Directive 93/42/EEC (installation, servicing, feedback, the so-called vigilance system, processing of claims and complaints, corrective and preventive action, and the so-called post market surveillance); 
• to store, view, copy, and create databases and perform analyses (for the purposes of territorial, business and product analyses);
• to create records of installation, maintenance and repair of products and send them to the end user (without the service engineer's data);
• to send notifications of an upcoming service of a product of EKOM, spol. s r. o. to the service engineer and the user (if the user gave his/her consent);
• to send notifications of an upcoming expiration of a certificate issued by EKOM, spol. s r. o.;
• to send marketing information of EKOM, spol. s r. o. (based on the special consent of the information recipient);

By registering in the EKOM App, you grant EKOM, spol. s r. o. your consent to process your personal data within its own organisational structure for the purpose of fulfilling contractual and legal obligations pertaining to sales, quality system management, performance of processing operations and marketing. EKOM, spol. s r. o. will make your personal data available to public authorities (public authority bodies) exclusively within the framework of fulfilling obligations imposed by the law or other generally binding legal regulations, even outside the territory of the Slovak Republic, especially when fulfilling requirements related to health care and national security. EKOM, spol. s r. o. reserves the right to provide your personal data to third parties within the necessary and reasonable scope, if this is necessary to:

• protect an interest which is essential for the life or health of the data subject or another natural person;
• pursue a substantial public interest;
• ensure network and information security, i.e. the ability of a network or an information system to withstand, at a given level of confidence, accidental events or unlawful or malicious actions that compromise the availability, authenticity, integrity and confidentiality of stored or transmitted personal data, and the security of the related services offered by, or accessible via, these networks and systems 
• make anonymised data available to third parties as part of improving the quality of products and services of EKOM, spol. s r.o. (anonymised data do not allow identification of a specific data subject);
• establish, exercise, or defend legal claims or enforce the rights of EKOM, spol. s r. o. in a different manner, to protect the safety of other persons, to support an external audit, and to ensure compliance with legal standards, administration and management of EKOM, spol. s r. o.

EKOM, spol. s r. o. is responsible for the protection of your personal data against unauthorised processing and disclosure to unauthorised persons and is also responsible for the continued availability of the EKOM App to enable you to cancel your registration, as well as to check, correct and delete your personal data processed in the EKOM App.

You can check the correctness of your personal data after logging into the EKOM App in Settings.

You can correct your personal data in the EKOM App in Settings. By correcting your personal data, you consent to provide your corrected personal data and have them processed for the above-mentioned purpose and in the above-mentioned scope.   

You can cancel your registration in the EKOM App by clicking the button Cancel registration in Settings.

You can withdraw your consent to the provision and processing of your personal data in the EKOM App for the above-mentioned purpose and to the above-mentioned extent by clicking the button Cancel registration in Settings.

You can object to the processing of your personal data in the EKOM App for the above-mentioned purpose and within the above-mentioned scope by sending the request to e-mail address web@ekom.sk.
